Accessing Medical Abortion: Laws and Regulations

In India, medical abortion is regulated by the Medical Termination of Pregnancy (MTP) Act, first enacted in 1971 and updated in 2021 to expand access and guidelines. Here’s an overview of the key points regarding access:

Medical Abortion Legal Conditions

  • All women and minors at risk are allowed a medical abortion up to 20 weeks into pregnancy, and up to 24 weeks for children and for women with fetal abnormalities in cases of sexual violence.
  • Under a medical board recommendation, the only situations in which abortion past 24 weeks is allowed are when the mother's life is in danger, or when there are severe fetal abnormalities.
  • Medical abortions can only be carried out by accredited medical practitioners in the authorised health establishment. The process can be managed at home after consultation if the pregnancy is less than 7 weeks.
  • The MTP Act provides confidentiality and requires the woman’s consent. Only for minors is parental consent needed.
